Two American airmen parachuted to safety in the vicinity of Halchter, Germany, surrendered and were taken to City Hall. After searching the airmen the accused, armed with a pistol left City Hall with the two airmen. Shortly thereafter both airmen were shot by the accused near a gravel pit. One airman was killed immediately while the other suffering from a chest wound was taken to a barn where the Red Cross was stationed. The accused learned of the whereabouts of the injured airman and set out after him. Once finding him the accused shot the airman in the head
