While being held in the Berga Prisoner of War Work Camp, a sub-camp of Stalag IX-C in Thuringia, American POW's, captured during the Ardennes counter-offensive, were forced to work under poor physical conditions and required to help construct tunnels. After being recaptured, a prisoner who had fled the camp was shot and killed by the accused. The accused aided and participated in assaults upon the POW's by beating them about the body and face and encouraged and participated in their mistreatment by failing to provide adequate food, medical care, and clothing, resulting in the deaths of several members of the United States Army both in the work camp as well as during the evacuation march into Bavaria
