After parachuting from a disabled plane an American airman landed in a tree. The accused along with a group of civilians proceeded towards the injured airman. Once the accused was close enough to the airman he fired a shot from his rifle that struck the flier in the arm. After cutting the airman loose from his parachute it was discovered that the airman had received severe injuries from anti-aircraft fire. The airman was taken to the nearby hospital and operated, but died the following morning as a result of his injuries
